1. SUBJECT OF THE PORTAL AND OFFERED SERVICE
The portal "Visiting Pompeii" represents a virtual platform where users enjoyed the service here offered, in particular of the consultation of news about the ancient City and the archaeological area of Pompeii. In fact the portal provides all the information about the majority of domus discovered until today. At the same time, the recalls to the Greek mythology are frequent. The Greek mythology that, in many domus has inspired frescoes and works of which it is going to talk about. The provided news are proposed either in text and in audio. It is to qualify that all the points of interest treated inside "Visiting Pompeii" have been chosen because of their artistic and/or historicalvalue; it is not therefore guaranteed that all the treated points can actually be visited or not inside the archeological area of Pompeii.
2. SERVICES ACCESS
The devices (computer, software, means of telecommunication, etc.) that allow services access, besides the costs of telecommunication deriving from their use, are at the user’s only responsibility (user service).

The portal is composed of two sections.

2.1 Free services access
The first section is at free consultation and is about:
  • The general history of the ancient city of Pompeii;
  • Mentions about the tragic Vesuvius eruption in 79 B.C.;
  • The history of excavation works, used techniques and mentions about the archaeologists followed one another during time;
  • Order of the ancient city;
  • Structure of the house typical of that age;
  • Artistic techniques and material uses during that period.
2.2 Payment services access
The second section is about a virtual "Tour" (as it follows "tour") inside the archaeological site of Pompeii. The proposed "tour", begins in porta marina and crosses the whole ancient city. For each one of the points of interest that the drafting has considered worthy of study (over 100), are described the environments and explained the pieces of art (frescoes, mosaics, paintings, etc.), the Greek Myths that have inspired them, and curiosities about the daily life in that time. To make the virtual "Tour" more realistic it is provided the visualisation of a map of Pompeii archaeological area with the indication of all the treated points of interest.
2.2.1. Prices, deadlines and methods of payment
The "tour" access is allowed only for the owners of an identification code which is possible to buy also directly on the portal according to ways and prices there indicated. The bought code has not a deadline and can be used even after a long time from the purchase. However from the first time it is entered in the system has a status of 24 (twentyfour) hours, within which it may be used even several times.
3. SERVICES USE
The access to services on "Visiting Pompeii", as well as the relative portal "Visiting Pompeii", can be suspended, limited or interrupted at any time. The Company owner of "Visiting Pompeii" reserves the right to stop the access to any material and/or to remove any material, that, to reasonable and unchallengeable its judgment, might result to violations of purposes and conditions related to services offered by "Visiting Pompeii".
3.1 Obligations of the Company owner of "Visting Pompeii"
The activity of the Company owner of "Visiting Pompeii" does not include the organisation of guided "Tour" inside the archaeological area, not the providing of an internet access. From the moment that the owner of "Visiting Pompeii" is not connected anyhow with the archaeological area of Pompeii and its administration, she can not materially assure that all the treated points of interest in the portal are effectively accessible or not.
3.2 Obligations of the user
The user has the obligation to use the Services according to the purpose described in Conditions of Use. The default represents violation and the owner of "Visiting Pompeii" will solve the contract and disable the access code to the payment section before its natural expire (twenty four hours from the first utilization).
4. RIGHT OF WITHDRAWAL
After having purchased an identification code for the access to payment services. User has a period of 7 (seven) days from the date of the purchase, to practice his own right of withdrawal without penalty and without any particular reason. The user can practice this right simply sending a communication to the editing staff of the portal through the means of contact present on the portal itself. It is to precise that the right of withdrawal is exercisable exclusively within and not over the deadline and only if the code (subject of the transaction) it is not already been used. The terms within which it is exercisable the right of withdrawal expire so before the 7 (seven) days indicated in the previous commas, if the user uses the code subject of transaction. If the user practices right of withdrawal, the owner Company of the portal will repays him the total of amounts paid within a deadline of fourteen days from the date in which the Company it is informed about the decision of the user to withdraw, without undue delay and without that the user has to hold any cost as consequence of the refund. The refund will happens through ways decided by the user himself in the communication of willing to exercise the right of withdrawal.

7. AGREEMENT BETWEEN THE CONSUMER AND "VISITARE POMPEI"
"Visitare Pompei" disclaims all responsibility related to any breach of the obligations under "Visitare Pompei" and that are presented in the conditions of use for force majeure hypothesis or for reasons beyond the control of "Visitare Pompei". This document contains all the terms agreed by the parts related to the services offered by "Visitare Pompei", that includes and prevails on every agreement previously written by the parts, both oral and written. No statement, commitment, which means promise, will be considered as the result, explicitly or implicitly, of any oral or written statement made by the parts during further negotiations. In case of one or more requirements of the conditions of the use are declared null in application of a law, a regulation or after a final judgement of a competent jurisdiction, the other requirements will be still entirely valid to the extent permitted by the said judgement. Moreover, the inaction of one part, in case of default of the other part of any disposition of the conditions of use, will not be interpreted as a failure to act in respect of that default.
8. COOPERATION COMMITMENT WITH THE AUTHORITY
"Visitare Pompei" undertakes to cooperate, collaborate and operate, in any way, to all the competent authorities, including the judicial authority if they order or require the communication of the available data (IP address) of anyone who is responsible on any informatics violation.
9. APPLICABLE LAW
The applicable law to those conditions of use is the Italian one.
